These terms are a contract between you and [TO BE COMPLETED: registered company name], the company that operates GTAMarket at gtamarket.store. Read them before you create an account. If you do not accept them, do not use the service.
We have written these terms to be read. Where a clause limits what you can claim from us, or lets us hold or take your money, it is written plainly and it is not hidden in a longer paragraph.
1. Who we are
GTAMarket is operated by:
- [TO BE COMPLETED: registered company name]
- Registration number [TO BE COMPLETED: company registration number]
- [TO BE COMPLETED: registered office address], [TO BE COMPLETED: country of incorporation]
- legal@gtamarket.store
In these terms, "we", "us" and "our" mean that company. "You" means the person using the service. "The service" means the website at gtamarket.store, the GTAMarket application, and everything we provide through them.
2. Definitions
Buyer — a user who places an order.
Seller — a user who publishes a listing and delivers what it describes.
Listing — an offer published by a seller.
Order — a contract of sale between a buyer and a seller, formed when the buyer places the order and we accept payment for it.
Escrow — the state in which the order amount sits after a buyer pays and before it is released to the seller. Money in escrow belongs to neither party until the order resolves.
Balance — the amount recorded against your account in our ledger. Section 9 explains exactly what a balance is and is not.
Hold — the period after an order completes during which the seller's share sits in the seller's balance but cannot yet be withdrawn.
Publisher — the company that owns and operates a game, including anyone acting for it.
Trader — a user acting for purposes relating to their trade, business, craft or profession. Section 3.4 explains how we decide.
3. Your account
3.1 Age
You must be 18 or older, or older still if the age of majority where you live is higher. You warrant that you are. This is a warranty, not a preference: we will close accounts we find to be held by people under 18, remove their listings, and return any balance to the source it came from rather than paying it out.
We may verify your age at any time and suspend an account until you complete that verification. Your date of birth is collected at registration and cannot be edited afterwards. Where we verify your identity for a payout, we read the date of birth from the document and check it against the one you gave us.
If you are a parent or guardian and believe a child has an account here, write to support@gtamarket.store and we will act.
3.2 One account
One person, one account. Running more than one account, or holding an account for someone else, is a breach of these terms. If we find linked accounts, we may suspend all of them.
3.3 Keeping your account secure
You are responsible for your password, for your two-factor device, and for everything done through your account. Tell us at support@gtamarket.store as soon as you think someone else has access.
We will never ask you for your password, your two-factor codes, or your recovery codes. Nobody who does is from us.
3.4 Trader or private seller
When you start selling we ask you to tell us whether you are selling as a business or privately. That declaration matters, because buyers get different legal rights depending on the answer, and we show your status on every one of your listings.
Your declaration does not settle the question on its own. Trader status is a matter of fact, judged on things like how often you sell, how much you sell, whether you buy in order to resell, and whether you sell for profit. We apply published thresholds — see the Seller Terms — and when you cross one, we reclassify you as a trader, tell you why, and ask you for the information Section 3.5 requires. You can contest a reclassification.
3.5 Information we need from traders
If you sell as a trader, before you can list we need: your name, address, telephone number and email; a copy of an identification document or an equivalent electronic identification; your payment account details; your trade register and registration number if you have one; and a statement from you that what you offer complies with the law that applies to it.
We check what you give us against public official databases where they exist. If something is wrong, out of date or missing, we will ask you to fix it, and we will suspend your selling if you do not. We publish your name, address, telephone number and email on your listings, because the law requires a trader to be reachable by the people who buy from them.
We keep this information for as long as you sell here and for six months after, then delete it. Records we are separately required to keep for anti-money-laundering purposes are held under our AML policy and on a different schedule.
4. What GTAMarket is, and what it is not
We are a venue and an agent. Sellers list, buyers buy, and we run the place where that happens. When a sale goes through we act as the disclosed commercial agent of the seller for the purpose of collecting the price, holding it in escrow, deducting our fee and paying the balance on. That agency is why we are able to hold the money at all, and it is disclosed to you here so that you know it.
We are not the seller. We do not own what is listed. We do not stock it, price it, write its description or deliver it. The contract of sale is between the buyer and the seller. We are not a party to it.
We do not guarantee what is listed. We do not warrant that a listing is accurate, that a seller can deliver, that a buyer can pay, or that what is delivered will remain available to you afterwards. Section 15 sets out what we do and do not accept responsibility for.
We are not a bank. Section 9.
5. We are not connected to any game publisher
GTAMarket is an independent marketplace run by players, for players. We are not affiliated with, endorsed by, sponsored by, authorised by or connected to Rockstar Games, Take-Two Interactive, or any other game publisher or developer. Where a game's name appears on this service, it appears only to identify what a listing relates to. No publisher has approved anything here.
We do not use any publisher's logos, artwork, screenshots, gameplay footage, character art, fonts or trade dress, and sellers may not either. See the Intellectual Property Policy.
Read this part carefully, because it is the part people skip. A game publisher's own terms — the agreement you accepted when you installed and played the game — will very often say that in-game value may not be sold for real money, that accounts may not be transferred, and that a player may not play on another person's behalf. Those terms are between you and the publisher. They are not ours to waive, change or interpret, and nothing on this service does so.
The consequences of that are real and they fall on you:
- A publisher may suspend or close your game account.
- A publisher may remove, reverse or reduce in-game value that was transferred to you.
- A publisher may do either of those things at any time, before or after an order completes, and without telling either you or us.
We cannot prevent any of that, and we do not insure you against it. What we do instead is publish, in advance, how the loss is split between a buyer and a seller when it happens — see codes D-09 to D-11 in the Refund and Dispute Policy. Decide whether that is a risk you want before you place an order, not after.
This applies hardest to accounts. A publisher's terms will usually prohibit transferring one outright, which makes it the category where a publisher is most likely to act and where the loss is largest when it does. If that is not a risk you want, buy currency, items or services instead — the risk profile is completely different. The Account Trading Rules set it out in full.
6. Listings
6.1 What may be sold
Only what the Prohibited Use Policy permits. That policy is part of these terms. Read it before you list anything — it is short, and it is the document most likely to get an account closed.
Two rules from it are important enough to repeat here:
- Everything you sell must be yours to sell, and must have been obtained by playing the game as the publisher permits. Anything produced or increased using third-party software that modifies, automates or interferes with a game, or by taking advantage of a fault in it, is not permitted here. This is a warranty you give us and the buyer, not a policy we aspire to.
- Accounts are traded under their own rules. They are the highest-risk category here, and the Account Trading Rules govern them: what may be listed, what a seller warrants, the handover checklist, the inspection window, the payout hold and the dispute outcomes. Read that document before you list or buy an account — Section 1 of it is the part people wish they had read first.
6.2 How your listing is described
You write your listing. You are responsible for its accuracy, including quantity, delivery method, delivery time and anything a buyer would reasonably want to know before ordering. Describe what the buyer receives — not how it came to exist.
6.3 What we do with listings
We review listings and messages, automatically and by hand, against these terms and the Prohibited Use Policy. We do this because the law requires it of a service like ours and because a marketplace without it becomes unusable, not as a quality guarantee to buyers. Review is not endorsement. A listing being visible does not mean we have checked that the seller can deliver it or that the description is true.
Where we remove a listing, demote it, stop it earning, suspend an account or end one, we will tell you: what we did, how long it lasts, what we relied on, whether we used automated tools, and either the law or the specific clause of these terms that grounds the decision — together with how to contest it. That notice goes to you and, where the law requires, to the European Commission's public database of such decisions.
You can contest any of it. Section 12.
7. Orders, escrow and delivery
7.1 Placing an order
An order is formed when you place it and we take payment for it into escrow. Minimum order value is $0.50. Prices are shown in US dollars and are the price you pay: buyers pay no fee.
7.2 Escrow
The money sits in escrow. The seller cannot reach it. We do not lend it, invest it or use it for anything else.
7.3 Delivery and confirmation
The seller delivers by the method and within the time their listing states. You then confirm delivery. If you neither confirm nor open a dispute, the order auto-confirms after 72 hours for most categories — the exact deadline is shown on the order, as both a countdown and a fixed time in UTC.
Opening a dispute stops that clock. It restarts only when the dispute closes.
7.4 Release
On confirmation — yours or automatic — we deduct the seller's fee and move the rest to the seller's balance, where it sits under a hold before it can be withdrawn. Hold lengths are published in Fees and Payouts and never exceed 14 days, except while a dispute about that order is open.
7.5 If something goes wrong
Open a dispute on the order. The Refund and Dispute Policy sets out the thirteen outcomes, the refund range attached to each, the evidence we ask for, and the deadlines. We aim to respond within 12 hours and to decide within 72 hours. You get one free appeal, decided by someone who did not decide it the first time, within 72 hours of the decision.
7.6 Keep it on the service
Do not arrange payment or delivery outside GTAMarket, and do not ask anyone to. If you do, there is no escrow, no dispute process and no record — we cannot help you, and we will suspend accounts that do it. This is not about our fee; it is where almost every loss in this market comes from.
8. Your right to cancel
If you are a consumer in the EU, the UK, or anywhere else giving you a similar right, you normally have 14 days to change your mind about a distance contract. Two things narrow it here, and we ask you to agree to them at checkout in words you can read before you pay.
Digital content — in-game currency and items. Delivery starts as soon as you order. At checkout you tick a box asking us to begin immediately and acknowledging that you lose the right to cancel once delivery has begun. If you do not tick it, delivery does not begin, and you keep the full 14 days.
Services — anything a person performs for you. At checkout you tick a box asking the seller to begin immediately and acknowledging that you lose the right to cancel once the service has been fully performed. Until it is fully performed you may still cancel, and you pay only for the part already done.
The boxes are separate and never pre-ticked. We email you a confirmation of your order restating both. Full instructions and a model cancellation form are in Your Right to Cancel.
This section is about cancelling. It has nothing to do with an order that went wrong — for that, see Section 7.5, and your legal rights are unaffected either way.
9. Your balance
Read this section. It is the one about your money.
What a balance is. A balance is a contractual claim against us for a stated amount, recorded in our ledger, arising because you deposited value or sold something here.
What a balance is not. It is not a bank deposit. It is not electronic money. It is not an investment, and it is not held in a segregated or protected account unless we say otherwise in writing on this page. It earns no interest. No deposit-guarantee or investor-compensation scheme covers it. [TO BE COMPLETED: registered company name] is [TO BE COMPLETED: either 'a registered obliged entity under the named law' or 'not a licensed or registered financial institution; the standards below are applied voluntarily'].
How money reaches us. Deposits are processed by [TO BE COMPLETED: licensed payment processor of record], a third party with its own terms. We do not take card payments and we do not hold fiat currency. Balances are denominated in US dollars and settled in cryptocurrency.
Third-party risk you carry. The tokens used for settlement are issued by third parties who can freeze, blacklist or redenominate them, at their own discretion or on the order of an authority. Blockchains can congest, fork or fail. Network fees and confirmation times are not ours to control. A transfer sent to the wrong address or over the wrong network cannot be recovered by anyone, including us. We are not liable for any of this.
Withdrawals, and the one thing about them that surprises people. Your available balance is one number to spend but two numbers to withdraw, and we would rather explain that here than have you discover it at the moment you want your money.
- What you earned here — money from your own sales, once its payout hold has ended — withdraws to any confirmed payout address of yours. Minimum $5.00, no fee at any amount, and nothing waiting on a person.
- What you deposited — money you put in and have not spent — can still leave, but it goes back the way it arrived and a person checks it first. It is not instant, and it does not go to an address of your choosing.
Why. A service where money can be deposited and then withdrawn untouched to any address is a payment service, whatever it calls itself, and it is precisely the route used to move criminal proceeds through a marketplace. We are not that, we do not want to be treated as that, and the rule above is what keeps it true. It costs an honest buyer nothing: deposited money spends here with no delay at all.
We will not keep money you did not spend. If you deposited and changed your mind, ask us and you get it back. The condition is where it goes, not whether you get it.
Your wallet shows the split. Before a withdrawal leaves, we screen the destination address and we may be required to pass your identifying information to the receiving provider. We may refuse or delay a withdrawal where that information cannot be obtained, where the receiving provider cannot accept it, or on any of the grounds in Section 9.1.
9.1 When we may hold, freeze or take from a balance
We may freeze a balance, or part of one, only where:
- (a) a law, a regulator, or a court or authority with jurisdiction requires it;
- (b) we reasonably suspect fraud, money laundering, sanctions exposure, or that funds or credentials involved were stolen;
- (c) there is a live dispute, chargeback or reversal that the amount may be needed to settle;
- (d) you have not completed identity or source-of-funds verification we have asked for; or
- (e) you have breached a specific clause of these terms, which we will identify.
We will tell you that we have done it and why — unless the law forbids us from telling you, or telling you would prejudice an investigation. That exception is narrow and we do not use it to avoid an awkward conversation.
A freeze lasts no more than 30 days, unless (a) applies or a dispute or investigation is still live, in which case we tell you and give a new date. You may appeal a freeze, a human being reads the appeal, and we answer within 72 hours.
We may set off against your balance: fees you owe; refunds we have paid a buyer on your behalf; amounts reversed upstream by a processor; and sums due under Section 16. We will itemise anything we take.
We do not confiscate balances. When your account closes, whatever remains after deductions we have itemised is returned to you, unless the law requires us to retain it or the money is the proceeds of crime.
10. Fees
Sellers pay 6%. Buyers pay 0%. Selling volume lowers the seller rate to as little as 4%. Withdrawals are free above the $5 minimum.
The full table — rates by rank, hold lengths by category, and the rules on how a rate you were promised is honoured — is in Fees and Payouts. We do not change the fee on an order that already exists.
11. Disputes between a buyer and a seller
If you and the person on the other side of an order disagree, use the dispute process. When you open a dispute you are asking us to decide it, and you agree that our decision settles the matter between you as far as this service is concerned — the order is refunded, released or split as we decide, and we act on that.
Deciding a dispute is us applying published rules to evidence. It does not take your legal rights away. It does not stop you going to court, or to a consumer body, and if you are a consumer nothing here can require you to give up a remedy your own law gives you.
Do not raise a chargeback or a payment dispute with a third party while a dispute is open here. It freezes our ability to investigate and it does not get you your money faster.
12. Restrictions, suspension and ending your account
12.1 What we may do
We may remove a listing, limit your account, suspend it, or close it, where you breach these terms or a policy they include, where the law requires it, or where we reasonably suspect fraud or another serious risk to other users. We act proportionately: a first minor breach gets a warning, not a ban.
12.2 What you get when we do
A written statement of what we did, its scope and duration, the facts we relied on, whether we used automated tools, the legal or contractual ground, and how to contest it. If you are a trader, we give you that statement before or at the moment the restriction takes effect, and 30 days' notice before ending your account — unless the law requires otherwise or you have repeatedly breached these terms.
12.3 Automated decisions
Some risk decisions start automatically — velocity checks, duplicate-account detection, address screening. Where an automated decision would freeze your balance, refuse a payout or close your account, you are entitled to a human review. Ask for it, tell us anything you want considered, and a person will look. We describe what these systems weigh in the Privacy Policy.
12.4 Ending it yourself
Close your account whenever you like, from your settings. Finish or cancel your open orders first. We return your remaining balance under Section 9.
13. Content you post
Listings, messages, images, reviews — you keep ownership. You give us permission to host, display, reproduce and adapt it as needed to run the service and to show your listings to the people who might buy them. That permission ends when the content comes down, except for copies we must keep for records, evidence in a dispute, or a legal obligation.
You are responsible for what you post, and you confirm you have the right to post it.
14. Our own material
The GTAMarket name, our logo, our interface, our text and our code are ours. You may not copy them, scrape the service, or use our name in a way that suggests we endorse you. Third-party names appearing here belong to their owners.
15. What we are responsible for
We are responsible for running this service with reasonable care and skill, and for the specific things these terms promise: that escrow works as described, that fees are what we published, that disputes are decided under published rules by a human being, and that your balance is paid out when it is due.
We are not responsible for what a seller delivers or fails to deliver, what a buyer does with it, whether a listing is accurate, or what any game publisher does to a game, an account or the value in it.
Where we are liable, our liability for any order is capped at the greater of the value of that order and the total fees you paid us in the twelve months before the claim.
That cap does not apply to your balance — we always owe you your own money — nor to fraud or fraudulent misrepresentation by us, nor to death or personal injury caused by our negligence, nor to anything the law where you live does not allow us to limit. If you are a consumer, nothing in these terms removes a right your own law gives you.
We do not exclude liability for direct loss caused by our own breach of these terms. We do exclude liability for loss of profit, loss of opportunity and other indirect loss, to the extent the law allows.
16. Indemnity
If you are a trader, and a claim is brought against us because of something you sold, something you posted, or your breach of these terms, you will cover our reasonable costs of dealing with it. We will tell you promptly, let you take part in the defence, and not settle without asking you first. This section does not apply to consumers.
17. Changes
We may change these terms. For a change that affects your rights, we give at least 15 days' notice by email and in the application before it takes effect, and traders get that notice on a durable medium. Keep using the service after it takes effect and you have accepted it; if you would rather not, close your account and withdraw your balance.
We fix typographical errors and broken links without notice. We do not use that to make substantive changes.
18. Governing law and where a claim goes
These terms are governed by the law of [TO BE COMPLETED: governing law, expected to match OPERATOR_COUNTRY], and claims may be brought in the courts of [TO BE COMPLETED: competent courts].
If you are a consumer, that sentence does not take anything away from you. You keep the protection of the mandatory law of the country where you live, you may bring a claim in your own courts, and we may sue you only there. There is no mandatory arbitration in these terms and no waiver of your right to take part in a group claim — those apply, if at all, only to traders, under the Seller Terms.
19. Everything else
Severance. If a clause is unenforceable, the rest stands.
No waiver. If we do not enforce something immediately, we have not given it up.
Assignment. You may not transfer your account or your rights under these terms. We may transfer ours to a company that takes over this business, on notice, and not in a way that reduces your rights.
Language. These terms are written in English. A translation is provided for convenience; where they differ, the English version governs.
Whole agreement. These terms and the policies they name are the whole agreement between us.
Force majeure. Neither of us is liable for a failure caused by something genuinely outside our control.
