The EU Digital Services Act requires an online platform to publish certain contact points, to run a specific mechanism for reporting unlawful content, and to explain what happens when it restricts someone. This page carries all of it in one place.
1. Who we are, for these purposes
GTAMarket is operated by [TO BE COMPLETED: registered company name], registration number [TO BE COMPLETED: company registration number], [TO BE COMPLETED: registered office address], [TO BE COMPLETED: country of incorporation].
We are a hosting service and an online platform. Because some sellers here are traders selling to consumers, we are also an online platform allowing consumers to conclude distance contracts with traders.
We are not a very large online platform. We are below the threshold by a wide margin, and we will publish our average monthly active recipients in the Union here if we approach it.
2. Contact points
For users
This address reaches a person. It is not an automated chatbot and it does not require you to use one first. You can also reach us at support@gtamarket.store or through the support form in the application. We answer in English.
For Member State authorities, the European Commission and the Board
Communications are accepted in English and in the official language of the Member State where our legal representative is established.
Legal representative in the Union
[TO BE COMPLETED: DSA Art. 13 legal representative, or 'Not required — established in the EU'], [TO BE COMPLETED: DSA_LEGAL_REP_ADDRESS]
Our legal representative may be addressed on all matters necessary for the receipt of, compliance with and enforcement of decisions relating to this regulation.
3. Reporting unlawful content
Anyone can report content on GTAMarket they consider unlawful. You do not need an account, and you do not need to be affected by it.
How: use the Report control on the listing, message or profile, or write to dsa@gtamarket.store.
What a notice needs, so that we can act on it:
- Why you believe the content is unlawful — enough of an explanation that we can assess it.
- Exactly where it is — a URL, or a listing or order reference. "Somewhere in the currency section" is not something we can act on.
- Your name and email address. Not required for reports concerning certain offences against children.
- A statement that you believe, in good faith, that what you are telling us is accurate and complete.
What happens next:
- We confirm receipt without undue delay.
- We assess the notice in a timely, diligent, non-arbitrary and objective way.
- We tell you what we decided, and what you can do if you disagree.
- We tell you whether automated tools were used in reaching the decision.
A notice that gives us enough to establish that content is unlawful without a detailed legal examination gives us knowledge of it, and we act expeditiously once we have that.
Copyright and trademark notices can go through this mechanism or through the Intellectual Property Policy, which sets out the additional detail those notices need.
4. Statements of reasons
Whenever we restrict a user, they get a written statement of reasons. That covers every kind of restriction: removing a listing, hiding it, pushing it down, stopping it earning, limiting an account, suspending one, and closing one.
Each statement says:
- what we did, its scope, and how long it lasts;
- the facts and circumstances we relied on, and whether the matter reached us through a notice or through our own checks;
- whether automated means were used, and where they were, that you can require a human review;
- the ground — either the law and the illegal content in question, or the specific clause of our terms and why the content is incompatible with it;
- how to contest it, and by when.
We submit these statements to the European Commission's public DSA Transparency Database, with personal data removed.
5. Contesting a decision
Reply to the statement of reasons, or write to support@gtamarket.store with the reference on it.
A person who did not make the original decision reviews it. We aim to answer within 72 hours. It is free.
Where the decision started with an automated system, you can require that a human being reviews it — that is a right under data protection law as well, and Section 12.3 of the Terms of Service describes the route.
This does not affect your right to go to a court, or to any out-of-court dispute settlement body certified in your Member State.
6. Our terms, and how we moderate
The rules we apply are in the Terms of Service and the Prohibited Use Policy. Both are written in plain language, both are public, and neither requires an account to read.
How moderation actually works here. Listings and messages pass through automated checks before publication — for prohibited categories, for contact details and links that move a conversation off the service, for publisher artwork, and for pricing far outside the market. Sellers below Gold rank have new listings reviewed by a person before they go live. Reports from users and rights-holders are reviewed by a person. Automated checks can hide a listing pending review; only a person closes an account.
We act diligently, objectively and proportionately, with regard to the rights and legitimate interests of everyone involved — including the freedom of expression of the person whose content it is.
Significant changes to those rules are notified at least 15 days before they take effect.
7. Trader traceability
Before a trader can sell here we collect and verify their name, address, telephone number, email, an identification document or equivalent electronic identification, their payment account details, their trade register entry where they have one, and their statement that what they offer complies with the law. We check that against official public databases where they exist, and we suspend a trader whose details we cannot reconcile and who does not correct them.
A trader's name, address, telephone number and email are published on their listings. Every listing also shows whether the seller is a trader, and every listing by a private seller carries a notice that EU consumer protection rules do not apply to that contract.
We keep the file for the duration of the relationship plus six months, then delete it.
8. If you bought something unlawful
If we become aware that an unlawful product or service was sold through GTAMarket, we will inform the buyers we can identify: what it was, who the seller was, and what remedies are available. Where we cannot reach them individually, we will publish it.
9. Reporting and transparency
While [TO BE COMPLETED: registered company name] qualifies as a micro or small enterprise, some of the reporting duties in the regulation do not apply to it. Everything on this page does, and we publish our average monthly active recipients in the Union on request from a Digital Services Coordinator or the Commission.
When we cease to qualify, we will publish an annual transparency report and our recipient numbers here, and we will build the rest of what applies within the period allowed.
10. Crime involving a threat to life or safety
If we suspect an offence involving a threat to the life or safety of a person, we inform the law enforcement or judicial authorities of the Member State concerned, or Europol, immediately.
