Part of the Terms of Service. It covers two things: our position on the games this marketplace relates to, and how a rights-holder gets something taken down.
1. We are not connected to any game publisher
GTAMarket is an independent marketplace where players buy from and sell to each other. It is not affiliated with, endorsed by, sponsored by, authorised by or connected to Rockstar Games, Take-Two Interactive, or any other game publisher or developer.
Where a game's name appears here, it appears in plain text and only to identify what a listing relates to. No publisher has approved, reviewed or licensed anything on this service.
2. Publisher material is not used here, by us or by anyone
We do not use, and sellers may not use, any game publisher's:
logos · wordmarks in stylised form · artwork · concept art · character art · screenshots · gameplay footage · trailers · promotional imagery · box art · fonts · colour schemes or trade dress · anything else that would suggest a publisher stands behind a listing or behind us.
This applies to listing images, listing text, avatars, banners, usernames, store names and anything else a person can see. Naming a game in plain words is permitted, and nothing more than is needed to identify it. Words like "official", "authorised", "genuine", "verified" or "legit" must never be attached to a publisher's name — they say something about the publisher's involvement, and the publisher has none.
Listings breaching this come down without waiting for anyone to complain. See Section 2.8 of the Prohibited Use Policy.
3. Your rights against a publisher are yours, not ours
A publisher's own terms with its players often prohibit selling in-game value for real money, transferring accounts, or playing on someone else's behalf. That is an agreement between the player and the publisher. We are not a party to it, we cannot waive it, and nothing here suggests we can.
Section 5 of the Terms of Service sets out plainly what a publisher may do to your game account or to value transferred to it, and Section 8 of the Refund and Dispute Policy sets out who carries that loss. Read both before you buy.
4. What sellers promise
Every seller warrants that what they list is theirs to sell, was obtained by playing the game in the way its publisher permits, and does not infringe anyone's rights. Anything produced or increased using software that modifies or automates a game, or by taking advantage of a fault in one, is prohibited here — see Section 2.1 of the Prohibited Use Policy. That is a warranty, and breaking it closes the account and reverses the sale.
For accounts the warranty is given per listing rather than only in these documents: an account listing cannot be published at all unless the seller affirmatively confirms it was built by ordinary play, and that confirmation is stored with the listing. The Account Trading Rules set out what else an account seller warrants and what a listing must disclose.
5. Reporting an infringement
5.1 Copyright
Send a notice to our designated agent:
- [TO BE COMPLETED: designated agent for IP notices], [TO BE COMPLETED: registered company name]
- [TO BE COMPLETED: registered office address], [TO BE COMPLETED: country of incorporation]
- ip@gtamarket.store
For us to act, a notice must contain all of:
- A physical or electronic signature of the owner, or someone authorised to act for them.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material complained of, with enough detail to find it — a listing URL, not a category.
- Your address, telephone number and email.
- A statement that you believe in good faith that the use is not authorised by the owner, its agent or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are authorised to act for the owner.
Notices missing element 3 or elements 5 and 6 cannot be acted on, and we will say so rather than ignoring them.
5.2 Trademarks and other rights
Trademark, design, database and other claims go to the same address: ip@gtamarket.store. Tell us the mark, the registration where there is one, the exact listing, and why the use infringes. There is no statutory form for these, so tell us plainly what is wrong and what you want done.
5.3 Unlawful content generally
Anything you consider unlawful, whether or not it is an intellectual property matter, can be reported through the notice-and-action mechanism described in the DSA notice. It accepts notices from anyone, and it commits us to specific steps and answers.
6. What we do with a notice
- We acknowledge receipt without undue delay.
- We assess it. A notice that identifies specific material and states a plausible claim is acted on expeditiously.
- We remove or disable the material and tell the user who posted it, giving the reasons, our source, whether an automated tool was involved, the ground we relied on, and how to contest it.
- We tell you what we decided.
- Where the decision restricts a user, a statement of reasons goes to the European Commission's public database, as the law requires.
We process notices on their merits, not on who sent them. A notice from a large rights-holder gets the same test as one from a person.
7. Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, send a counter-notice to ip@gtamarket.store containing:
- Your signature.
- Identification of the material and where it was before removal.
- A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification.
- Your name, address and telephone number, and your consent to the jurisdiction of a court where you live or, if outside the United States, where [TO BE COMPLETED: registered company name] may be found — and your agreement to accept service from the person who sent the notice.
We forward it to the complainant. If they do not tell us within 10 business days that they have gone to court, we may restore the material between 10 and 14 business days after receiving your counter-notice.
8. Repeat infringers
We terminate the accounts of repeat infringers.
That is a working procedure, not a sentence in a policy. Every notice acted on is logged against the account. Every strike, its date, the material and the outcome is recorded. When the count reaches the threshold in our internal procedure, the account is closed, and the record is what the decision rests on. We audit the log rather than trusting anyone's memory.
We also terminate immediately, without counting, where an account exists to infringe.
9. Bad-faith notices
Knowingly misrepresenting that material infringes carries legal consequences for the person doing it, and we will cooperate with anyone pursuing them. Sending repeated notices we have already rejected does not get a different answer; it gets a slower one.
10. Our own material
The GTAMarket name, our logo, our interface design, our written text and our code belong to [TO BE COMPLETED: registered company name]. Do not copy them, scrape the service, or use our name in a way that suggests we endorse you. Write to legal@gtamarket.store if you want permission for something.
